Terms and Conditions

These terms and conditions together with The Holiday Ferret’s privacy policy, set out your rights and responsibilities on using any or all aspects of The Holiday Ferret’s website. Please read carefully.  It is subject to change without notice.

Definitions

Site: The Holiday Ferret Ltd and the http://www.theholidayferret.com

Owner : Owner or manager of holiday or vacation property or properties.

Property: The property or properties that are owned or under managership of the Owner

Traveller: Anybody or party that wishes to rent the property from the owner.

Start Date: The beginning date the property is advertised on the site.

End Date: The expiry date of the property on the site. Twelve consecutive months from the start date.

1.0 Services

1.1 The Site agrees that the owner can advertise their first property free for three months without charge. This applies to the first property only.

1.2 The site agrees to advertise the property for a period of 12 consecutive months from the start date and terminates on the end date.

1.3 The site agrees to implement further advertising for the property as directed by the owner via advertising options featured in the ‘Owner Account’ page.

1.4 The site agrees to promote the site across social networks and search engines through undertaking advertisements and search engine marketing operations such as SEO and marketing promotions.

1.5 The site reserves the right to cancel the owner’s account and stop advertising the property without notice or refund, should the owner be found fraudulent, or indulge in continuing bad practise. 

1.6 The site reserves the right to cancel the owner’s account and stop listing the the property associated with the account without notice or refund, should payment be deferred or declined.

1.7 The site will display as many properties as the owner uploads, providing their account type supports it and subsequent payment is received

1.8 The site reserves the site to display the property on other sites as deemed fit by the site  to maximise a property exposure.

2.0 Owner

2.1 The owner agrees to pay the site the agreed sum as stated on the site for advertising the property on the site, for a duration of 12 consecutive months beginning at the start date and terminating at the end date.

2.2 The owner agrees that they have full and exclusive rights to advertise the property on the site, and all information displayed on the site by the owner is true and complete to the best of their knowledge.

2.3 The owner agrees to follow all guidance to market the property as stated in the Owner guide and on site.

2.4 The owner can request a refund within 30 days of issuing a payment.

2.5 The owner acknowledges and understands that the site is not responsible, cannot be held accountable, and makes no warranties, that advertising the property on the site will result in a booking of that property.

2.6 The owner acknowledges and understands that should any information be deemed fraudulent by the site, then the property can be removed from the site without notice,  reason, or refund.  The site may impose other measures as deemed appropriate.

2.7 The owner will keep the property in a good state of repair and safe to inhabit.

3.0 Travellers

3.1 The traveller understands and acknowledges that the site does not own or manage property advertised on the site, and makes no warranties as to the condition of the property in regards to, but not limited to the following:

●     The repair and maintenance of the property

●     The location of the property

●     The quality and likeness of the property to the advertisement of that property displayed on the site

●     The facilities of the property

●     Whether the property exists

3.2 The site makes no warranties on the credibility or the personal circumstances of the owner or their affiliates

3.3 The traveller accepts full responsibility as to any transaction or subsequent transactions between the traveller and any owner contacted via the site or, in regard to any property listed on the site.

3.4 The traveller accepts that the site has no legal obligations to the traveller in any regard whatsoever.

4.0 Warranties

 4.1 The site makes no warranties as to the condition or likeness of any property displayed on the site to the actual property or related information about the property.

4.2 The site makes no warranties and accepts no responsibility as to the condition, or ‘up time’ of third party servers that are used to display the site on the world wide web.

4.3 The site is not accountable and makes no warranties as to either the credibility of the owner or traveller, and the site accepts no responsibility or warranty in regard to any subsequent transaction between or by traveller and owner.

4.4 The site accepts no responsibility for any server ‘down time’ that is not directly caused by the site. This includes but is not limited to

●     Acts of God

●     Third party server maintenance

●     Third party server errors

●     Hacking, damage, or breaching, of the server by a third party

4.5 The site makes no warranty and accepts no responsibility for the amount of inquiries or bookings acquired via the site.

4.6 The site makes no warranties and takes no responsibility in regards to the credibility of bookings and inquiries

4.7 The site reserves the right to change these terms and conditions without notice.

5.0 Intellectual Property

5.1 The site contains material which is owned by or licensed to the site. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

5.2 All trademarks reproduced in this website which are not the property of, or licensed to, the operator are acknowledged on the website.

5.3 Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

5.4 From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that the site endorses the website(s).  The site has no responsibility for the content of the linked website(s).

5.5 The site reserves the right to demand that any links to the site from external websites are removed.

5.6 News page items created by the site can be distributed on other sites without charge or notice providing a hyperlink to the site is embedded in the news page item that is shown on the sites that use it.

Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Scotland and Wales.
